Acceptance of Terms

By accessing or using the noon mobile application and website (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Service Description

noon is a loyalty platform that:

  • Connects users with partner cafés and venues
  • Allows users to earn points through visits (tap-ins)
  • Provides bonus points for reaching daily step goals
  • Enables point redemption for free drinks at any partner location
  • Offers social features to discover friends and influencers

Eligibility

  • You must be at least 16 years old to use noon
  • You must provide accurate and complete information when registering
  • You are responsible for maintaining the security of your account

User Accounts

Account Security

  • You are responsible for all activity under your account
  • Do not share your password with others
  • Notify us immediately of any unauthorised access

Account Information

  • Keep your information up to date
  • Do not impersonate others
  • One account per person

Loyalty Programme

Earning Points

  • Points are earned through tap-ins at partner locations
  • Bonus points for reaching 5,000 steps before tap-in
  • Point values may vary
  • Points have no cash value and do not constitute a lottery, game of chance, or regulated gambling activity

Redeeming Points

  • Points can be redeemed at any partner location
  • Rewards are subject to availability
  • Redeemed points cannot be refunded
  • Partners may limit certain rewards

Point Expiration

  • Points expire after 12 months of account inactivity (no tap-ins, redemptions, or logins)
  • We will notify you by email and in-app notification at least 30 days before expiration

Points Adjustment

noon and participating cafés reserve the right to adjust, correct, or revoke points awarded in error, through system malfunction, or as a result of fraudulent or abusive activity. Cafés may also award bonus points for promotions, events, or customer-service gestures. All adjustments are logged and visible in your transaction history. You will be notified of any adjustment.

Step Tracking

  • Step tracking requires Apple Health or Google Fit
  • We verify threshold achievement, not detailed history
  • Manipulating step counts violates these terms
  • The step bonus is an optional feature. noon may modify, suspend, or discontinue it at any time without notice

Prohibited Conduct

You agree not to:

  • Cheat the points system (fake tap-ins, step manipulation)
  • Create multiple accounts
  • Share or sell points
  • Harass other users or café staff
  • Engage in fraudulent behaviour
  • Reverse engineer or hack the app
  • Violate others' rights

Intellectual Property

  • noon owns all rights to the Service
  • You grant us a licence to content you submit
  • Do not use our trademarks without permission

Disclaimers

  • Service provided "as is"
  • We don't guarantee uninterrupted availability
  • Partner cafés are independent businesses
  • We're not responsible for partner product quality

Limitation of Liability

To the extent permitted by law, noon is not liable for:

  • Indirect or consequential damages
  • Lost points due to inactivity
  • Actions of partner cafés
  • Service interruptions

Termination

By You

  • You can delete your account at any time
  • Unredeemed points are forfeited upon deletion

By Us

  • We may suspend or terminate accounts for violations
  • We'll attempt to warn you for minor issues

Changes to Terms

  • We may update these terms
  • Material changes will be notified 30 days in advance
  • Continued use means acceptance

Assignment

We may transfer our rights and obligations under these terms to another organisation. We will notify you in writing if this happens. You may not transfer your rights or obligations to anyone else.

Governing Law

These terms are governed by Swiss law. Any disputes shall be resolved through good faith negotiation, mediation if negotiation fails, or, at noon's election, binding arbitration administered under the Swiss Rules of International Arbitration, or court proceedings before the competent courts of Zug, Switzerland.
